POLITIX PLUS EXPERIENCE PROGRAM | TERMS AND CONDITIONS 

These Member Terms and Conditions document the operation of the POLITIX Plus Experience Program, and any promotional activity and member transactions that arise as a consequence of the POLITIX Plus Experience Program. Members agree to be bound by these Member Terms and Conditions.
 

$20.00 AUD WELCOME OFFER

The offer is available to new customers upon joining the POLITIX Plus Experience Program and signing up to receive email communication. This voucher is valid for the value of $20 AUD. This voucher can only be redeemed once by the individual who has signed up to email marketing communications and an account with POLITIX. This voucher is available to be redeemed on full price purchases only with a minimum spend of $75 AUD. Only the original voucher will be accepted and POLITIX wears no responsibility for lost or stolen vouchers. This voucher is valid for 60 days from the date of issue and is not redeemable for cash or to be used as a payment method for lay-bys. This voucher can be redeemed at all POLITIX stores in Australia (including POLITIX outlet stores), online at politix.com.au, and at David Jones stores in Australia that retail POLITIX merchandise. EXISTING MEMBERS/POLITIX ACCOUNTS

All current POLITIX account holders who signed up before 19 January 2023 will be automatically included in the POLITIX Plus Experience Program, which means they: 

  1. will be automatically assigned a Tier Status based on their 12 Month Spend Balance and this day becomes their anniversary; 

  2. are deemed to accept these Member Terms and Conditions; and may receive an email from POLITIX requesting further information required in their Member Profile to be able to participate in the POLITIX Plus Experience Program. 

GENERAL

  1. The Member Terms and Conditions may be modified by POLITIX at any time without prior notification by POLITIX in its absolute discretion. Any modification to the Member Terms and Conditions may be applied to a Member retrospectively.

  2. POLITIX may collect personal information from Members for the purpose of facilitating the POLITIX Plus Experience Program. Personal information will be handled in accordance with POLITIX’s Privacy Policy. If a Member has not provided or updated POLITIX with their accurate personal information, POLITIX may not be able to contact the Member about their membership, Benefits, special offers or entry to competitions.

  3. POLITIX reserve the right to cancel, terminate, modify or suspend the POLITIX Plus Experience Program or any aspect of it, to payout any Benefits, or reset 12 Month Spend Balances, at any time and without notice. Without limitation to the foregoing rights, POLITIX reserve the right to transfer Members to such other loyalty programs owned, operated, managed or administered by POLITIX, its ‘related bodies corporates’ or ‘associated entities’ (as those terms are defined in Corporations Act 2001 (Cth)).

  4. POLITIX will not accept any liability for any: 
    (I)    Emails about the POLITIX Plus Experience Program that are misdirected, lost or not received, including emails about a Member’s membership, special offers, discounts, competitions or events;
    (II)    Benefits that are lost, stolen or non-redeemable, for whatever reason, but specifically in the case of any Technical Issues, including without limitation the failure of software or hardware or an EFTPOS malfunction;
    (III)    Technical Issues that may cause damage to any computer related to or used in connection with the POLITIX Plus Experience Program; or
    (IV)    Tax liability incurred by a Member in connection with the POLITIX Plus Experience Program, including that incurred in the provision and/or utilisation of the Benefits.

  5. These Member Terms and Conditions are to be read in conjunction with any additional conditions associated with the Benefits, including without limitation with the Website Terms and Conditions.

  6. POLITIX’s decisions in relation to all matters arising in relation to the POLITIX Plus Experience Program are final and binding.

  7. Any failure or delay by POLITIX in exercising its rights under these terms does not constitute a waiver of those rights. A waiver by POLITIX must be in writing and signed by an authorised officer of POLITIX.

  8. Nothing in these Member Terms and Conditions is intended to contravene any applicable law. To the extent that any provisions in these Member Terms and Conditions is invalid or unenforceable, it is to be read down so as to be valid and enforceable, and otherwise must be severed to the extent of any invalidity or unenforceability, without affecting the remaining provisions of these Member Terms and Conditions.

MEMBERSHIP

  1. Members must be at least 18 years old and have an email address.

  2. An individual is deemed to be a Member from when they sign up either in store or online:
    (I)    In store sign up
    A sales consultant will record the Member’s full name, email address and postcode at the register. Other details may be optionally recorded. An individual may update their Member Profile at any time by visiting the Website. It is the Member’s responsibility to ensure the information in their Member Profile (including their email, surname, birthday, phone and postal address) is accurate. 
    (II)    Online sign up
    Follow the prompts to sign up in the checkout process. A Member is not required to agree to receive marketing material from POLITIX via email to be able to participate in the POLITIX Plus Experience Program.

  3. Upon joining the POLITIX Plus Experience Program, a Member will be allocated a Tier Status based on any 12 Month Spend Balance known to POLITIX at that time.

  4. At any time, Members may only hold one membership to the POLITIX Plus Experience Program.

  5. Members may not transfer their account or Benefits to another person.

  6. POLITIX reserves the right to modify, refuse or terminate a Member’s account to the POLITIX Plus Experience Program without notice or reason and at its absolute discretion.

  7. A Member may end their membership at any time by contacting POLITIX’s Customer Service team on 1800 765 484 or by email at online@politix.com.au. 

  8. By joining the POLITIX Plus Experience Program, Members consent to POLITIX contacting them to provide them with consumer or marketing information and notifying them of Benefits or other products and special offers. Members can contact POLITIX at any time if they no longer wish to receive marketing materials from us.

EARNING AND ACCESSING POLITIX PLUS BENEFITS

  1. Members are allocated a Tier Status and become eligible for the Benefits associated with that Tier Status on the basis of their 12 Month Spend Balance. If a Member’s 12 Month Spend Balance increases so that they become eligible for a higher Tier Status, the Member will be re-allocated into that higher Tier Status. If Member’s 12 Month Spend Balance decreases so that they are no longer eligible for the Tier Status they have been allocated, the Member will remain in that Tier Status until at least their Anniversary.

  2. At a Member’s Anniversary, their 12 Month Spend Balance as at that date will be assessed and if they are no longer eligible for their Tier Status, they will be re-allocated to the Tier Status for which they are eligible based on their 12 Month Spend Balance.

  3. To ensure spend is included in a Member’s 12 Month Spend Balance, Member’s must:
    (I)    if they’re spending in store, identify themselves to staff and provide their membership details, evidence of their Member Profile, and/or photo identification to sufficiently verify their membership to the satisfaction of POLITIX staff, and request to be issued with a digital receipt; and
    (II)    if they’re spending online, log into their Member Profile before spending.

  4. Only one POLITIX Plus Experience Program membership can be presented for each transaction.

  5. If POLITIX invites a Member to a special event they may be required to show their Member Profile or photo identification to gain entry or access.

  6. At its sole discretion, POLITIX may update a Member account with Benefits as a consequence of a purchasing behaviour, incentive and/or promotional activities.

  7. POLITIX reserves the right to withdraw, cancel or vary the Benefits without notice and at any time for any reason whatsoever in its absolute discretion including without limitation Benefits awarded in error or Benefits earned fraudulently.

  8. Benefits cannot be sold, transferred or assigned and are not redeemable for cash or any other like instruments, including (but not limited to) gift vouchers, gift cards, cheques and credit notes. Benefits do not represent legal tender in any country.

  9. Benefits cannot be earned on a transaction where other Benefits were used.

  10. If a membership is terminated from the POLITIX Plus Experience Program, all outstanding and future Benefits will no longer be valid and will be rendered null and void.

  11. If a Member returns an item and the item was purchased using a Benefit, the spend of the item being returned will be deducted from the Member’s 12 Month Spend Balance, and:
    (I)    if the Member receives a refund for the spend, and the reason for the return is any reason other than that the item was faulty or misdescribed, the Benefit used to purchase the returned item will not be returned to the Member;
    (II)    if the Member exchanges the returned item, the Benefit used to purchase the returned item will not be returned to the Member, unless the exchange takes place on the same day as the return and the exchange item is of equal or greater value than the returned item (before any discount or application of Benefit); or
    (III)    otherwise, the Benefit used to purchase the returned item will be returned to the Member.

  12. If an online order is cancelled, POLITIX may adjust or reverse Benefits that were previously awarded to a Member on that spend.

  13. Members can view their Benefits at any time by logging into their Member Profile on the Website.

  14. Benefits can only be redeemed at POLITIX stores in Australia (including POLITIX outlet stores), online at politix.com.au, and at David Jones stores in Australia that retail POLITIX merchandise. Benefits cannot be redeemed at David Jones Online. 

  15. When redeeming any applicable Benefit, the Benefit may be applied to any item purchased, at the discretion of POLITIX. 

  16. Benefits cannot be redeemed in conjunction with any other offer unless otherwise indicated.

  17. Benefits cannot be redeemed as payment for any part of a layby purchase.

  18. Benefits can be redeemed as payment for Afterpay purchases at the time of purchasing, but before the first Afterpay payment takes place.

  19. All Benefits have an expiry date at which point they will no longer be available for redemption. POLITIX reserve the right to change the expiry date of any Benefits at any time without notice.

  20. Only one Benefit can be redeemed per transaction unless otherwise indicated.

  21. Benefits can only be redeemed once, unless otherwise indicated.

  22. POLITIX reserve the right in its absolute discretion to exclude certain items and promotions from being redeemed by using Benefits.

TIERS & ASSOCIATED BENEFITS 

  • A Black Tier Member is a Member whose 12 Month Spend Balance is less than $300.00 AUD. A Black Tier Member is entitled to the Black Tier Member Benefits subject to these Member Terms and Conditions.
    The Black Tier Member Benefits are as follows: 

    • (I)   $20 ‘Birthday Voucher’ issued once every 12 months (but the Member must have entered a valid date of birth in the relevant section of their Member Profile at least 15 days prior to their birthday in order to receive this Voucher). Expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (II)   Free standard delivery for online orders for shipping within Australia only. Not in conjunction with any other offer unless otherwise indicated;

    • (III)  Early access/access to sales and extra discounts on products not available to the public issued from time to time by POLITIX at its discretion and on such terms it sees fit; and

    • (IV)  Spend & Save offers: issued from time to time by POLITIX at its discretion and on such terms it sees fit.

  • A Silver Tier Member is a Member whose 12 Month Spend Balance is equal to or more than $300.00 AUD but less than $750.00 AUD. A Silver Tier Member is entitled to the Silver Tier Member Benefits subject to these Member Terms and Conditions.
    The Silver Tier Member Benefits are as follows:

    • (I)    $30 ‘Welcome Voucher’ issued every time the Member is allocated Silver Tier Member Tier Status which expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (II)   $30 ‘Anniversary Voucher’ issued on the Silver Member’s Anniversary, which expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (III)  $30 ‘Birthday Voucher’ issued once every 12 months (but the Member must have entered a valid date of birth in the relevant section of their Member Profile at least 15 days prior to their birthday in order to receive this Voucher). Expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (IV)  Free Standard Delivery for online orders for shipping within Australia only. Not in conjunction with any other offer unless otherwise indicated;

    • (V)   Early access/access to sales and extra discounts on products not available to the public issued from time to time by POLITIX at its discretion and on such terms it sees fit; and

    • (VI)  Spend & Save offers: issued from time to time by POLITIX at its discretion and on such terms it sees fit.

  • A Gold Tier Member is a Member whose 12 Month Spend Balance is equal to or more than $750.00 AUD but less than $1,500.00 AUD. A Gold Tier Member is entitled to the Gold Member Benefits subject to these Member Terms and Conditions.
    The Gold Tier Member Benefits are as follows:

    • (I)    $40 ‘Welcome Voucher’ issued every time the Member is allocated to Gold Tier Member Tier Status which expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (II)   $40 ‘Anniversary Voucher’ issued on the Gold Tier Member’s Anniversary, which expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (III)  $40 ‘Birthday Voucher’ issued once every 12 months (but the Member must have entered a valid date of birth in the relevant section of their Member Profile at least 15 days prior to their birthday in order to receive this Voucher). Expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (IV)  Free standard delivery for online orders for shipping within Australia only. Not in conjunction with any other offer unless otherwise indicated;

    • (V)   Early access/access to sales and extra discounts on products not available to the public issued from time to time by POLITIX at its discretion and on such terms it sees fit; and

    • (VI)  Spend & Save offers issued from time to time by POLITIX at its discretion and on such terms it sees fit.

  • An Emerald Tier Member is a Member whose 12 Month Spend Balance is equal to or more than $1,500.00 AUD. An Emerald Member is entitled to the Emerald Tier Member Benefits subject to these Member Terms and Conditions.
    The Emerald Tier Member Benefits are as follows:

    • (I)    $50 ‘Welcome Voucher’ issued every time the Member is allocated to Emerald Tier Member Tier Status which expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (II)   $50 ‘Anniversary Voucher’ issued on the Emerald Tier Member’s Anniversary, which expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (III)   $50 ‘Birthday Voucher’ issued once every 12 months (but the Member must have entered a valid date of birth in the relevant section of their Member Profile at least 15 days prior to their birthday in order to receive this Voucher). The Birthday Voucher expires 60 days after date of issue. Redeemable on full price items only. Not in-conjunction with any other offer. One time redemption only;

    • (IV)   Free standard delivery for online orders for shipping within Australia only. Not in conjunction with any other offer unless otherwise indicated;

    • (V)    Early access/access to sales and extra discounts on products not available to the public issued from time to time by POLITIX at its discretion and on such terms it sees fit; and

    • (VI)   Spend & Save offers issued from time to time by POLITIX at its discretion and on such terms it sees fit.

DEFINITIONS

Anniversary” means the date later in time of either:

  1. the 12 month anniversary of the calendar date on which the Member signed up to the POLITIX Plus Experience Program; and
  2. the 12 month anniversary of the calendar date on which the Member was last allocated to a Tier Status.

Benefits” means the POLITIX Plus Experience Program vouchers and benefits awarded to a Member based on their Tier Status.

"Effective Date" means 19 January 2023.

Member” means an individual who signs up to the POLITIX Plus Experience Program.

Member Profile” means the section of the Website that contains the Member’s personal information that relates to their membership in the POLITIX Plus Experience Program.

"POLITIX" means Cicero Clothing Pty Ltd ABN 72 614 757 327 its related entities and its authorised representatives.

POLITIX Plus Experience Program” means the loyalty program operated by POLITIX providing Members with access to Benefits in accordance with these Member Terms and Conditions.

Technical Issues” means the technical malfunction of any telephone network, connection or lines, computer on line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website or intranet site.

Tier Status” means the tier a Member is assigned to based on their 12 Month Spend Balance.

12 Month Spend Balance” means a Member’s net cumulative spend (after all discounts, returns etc. have been applied) in the previous 12 months, that POLITIX determines qualifies as a spend that contributes to the Member’s 12 Month Spend Balance. Spend from transactions made in store and online are added to a Member’s 12 Month Spend Balance the day after the transaction is made.

"Website" refers to the POLITIX website at politix.com.au where details of the POLITIX Plus Experience Program (including the most up to date Terms and Conditions) can be found and where Members can monitor their Tier Status and Member Profile.
